In
a notice dated February 1, 2008, that was included in all Morris County Municipal Utilities
Authority (“MCMUA”) transfer stations customer's monthly
statements delivered at the beginning of February, the MCMUA notified its customers of its intention to
increase the tipping fees charged at the MCMUA transfer stations
by $3.00/ton beginning on April 1, 2008. The $3.00/ton
increase in the disposal tipping fee was a result of the signing
of the Recycling Enhancement Act ("Act") by Governor
Corzine on January 13, 2008 which requires the additional of a new
$3.00/ton recycling tax.

Between
the signing of the law and April 1, 2008 the MCMUA transfer
stations did not include the $3.00/ton tax in the tipping fee
since the sponsors of the recycling tax introduced new bills in
both the Senate and Assembly to delay the implementation of this
tax until April 1, 2008. On January 28, 2008 both these
bills (S-796 and A-1910) were unanimously passed by their
respective committees and are heading for vote on both floors of
the New Jersey Legislature. It is anticipated that this bill
will get adopted and the tipping increases due to the $3.00/ton
recycling tax described above will take effect on April 1, 2008.
